Terms of service
These are the terms that apply when you book a journey with GoMotion Ltd, whether online, by phone or in person. Booking a journey — online or otherwise — means you accept them.
Who you're booking with
GoMotion Ltd (trading as GoMotion), 343 Stafford Road, Wolverhampton WV10 6DY. Licensed by Wolverhampton City Council, operator licence PHO-28471.
The fare
The price shown when you book is a fare estimate, based on the pickup and destination you give us and the vehicle you choose. If you pay online, that estimate is what's charged to your card at the time of booking. If the journey actually run turns out to differ materially from what was booked — for example a different route at your request, or extra stops — we will contact you before taking any further payment. We do not add charges you haven't been told about first.
Card payments are processed by Stripe. We never see or store your full card details ourselves.
Cancelling a booking
You can cancel any booking free of charge at any time before the journey takes place, from your account or by calling the office. If you paid online, a cancelled journey is refunded in full.
Under the Consumer Contracts Regulations 2013, some services booked online normally carry a 14-day right to cancel. A private hire journey booked for a specific time doesn't fit that model — by asking us to carry out the journey at the time you've chosen, you're asking the service to begin (and often complete) well within that 14 days. Once a journey has actually been carried out, it can no longer be cancelled or refunded, other than through the complaints process below if something went wrong. Right up until pickup, though, cancellation is free — see above.
If something can't be fulfilled
Occasionally we may be unable to fulfil a booking — no vehicle available in time being the most common reason. Where that happens we will tell you as soon as we know, and refund any payment taken in full. We are not liable for any further loss this causes you, except where the law does not allow us to exclude that liability (see below).
Our liability to you
We're responsible for carrying out the journey with reasonable care and skill, as required by the Consumer Rights Act 2015. Where something goes wrong that is our fault, our liability is limited to the fare paid for that journey, except for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or anything else that the law does not allow us to limit or exclude. Nothing in these terms affects your statutory rights.
Accessibility and passenger conduct
We ask about accessibility needs on every booking so your driver knows what to expect — see accessible travel for what we can arrange. Passengers are expected to treat drivers and vehicles with respect; a driver may decline or end a journey where a passenger's conduct makes it unsafe to continue, and where reasonably possible we will still get you to a safe location.
Your data
Booking with us means we hold and use your information as described in our privacy policy, including the records our operator's licence requires us to keep.
Governing law
These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
If something goes wrong
Tell us and we'll look into it properly — every booking carries a full record of what was booked, which driver and vehicle went, and what happened. You can also raise a complaint directly with Wolverhampton City Council, who licenses us.
